What information do we collect about you?

We collect information about you when you register an account with us, namely your name, e-mail address, telephone number, your username and password, your consent records, or place an order for our products so we can deliver your order, your purchase and payment details.

We also collect information when you voluntarily complete customer surveys, provide feedback and participate in competitions; we collect any comments, views and opinions that you choose to send to us, or publicly post about us on social media platforms. Anonymous website usage information is collected using Google Analytics. Cookies may be stored on your computer to remember actions you take on our website, such as adding a product to your cart, or selecting your shipping country – you can delete these at any time through your web browser’s settings.

How do we use the information about you?

We use your information to operate and manage our Site in order:

  • to create your account and manage your subscriptions;
  • to improve your browsing experience;
  • to manage your online purchases of Native Union products;
  • to organize for the shipping, billing, returning and exchanging of the products, receiving refunds; and provide after-sale services purposes (Customer Care) as well as your requests of information, questions or your feedback.

We use your information to conduct marketing activities such as:

  • direct marketing, including management of your subscription to our newsletter(s); participation to promotions and other initiatives, such as potential contests; sending you (subject to your consent, that is optional), also through e-mail, promotional information and material on our products and services, or on special initiatives on price and promotions;
  • survey purposes (subject to your consent, that is optional).

The other purposes of using your information may also be:

  • fraud prevention; 
  • compliance with our obligations under applicable laws and regulations.

Native Union and its own legal entities will not share your information for marketing purposes with companies outside of our Group.

You have the right at any time to stop us from contacting you for marketing purposes or giving your information.

If you no longer wish to be contacted for marketing purposes, please opt-out using the “Unsubscribe” link at the bottom of any of our marketing emails. Please note that opting out of our marketing emails will not unsubscribe you from transactional communications, including order confirmations and shipping notifications related to orders placed on our website.

What are your rights

Right of Access

You have the right to obtain confirmation from us as to whether or not personal data that concerns you is processed, and, if so, to request access to such personal data including, without limitation, the categories of personal data concerned, the purposes of the processing and the recipients or categories of recipients. However, we do have to take into account the rights and freedoms of others, so this is not an absolute right. If you request more than one copy of the personal data undergoing processing, we may charge a reasonable fee based on administrative costs.

Right to erasure ('right to be forgotten')

You have the right to request from us the erasure of personal data concerning you in certain circumstances as defined under applicable law. When your request falls within one of those circumstances, we will erase your personal data without undue delay. If, for technical and organizational reasons, we were not able to erase your personal data, we will ensure that it is fully and irreversibly anonymized so that we will no longer be holding such personal data about you.

You have the right to request from us the rectification of inaccurate personal data concerning you.

In certain circumstances as defined under applicable law, you have the right to request the restriction of processing of your personal data. In such case, your personal data shall, with the exception of storage, only be processed with your consent or for the establishment, exercise or defense of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest.

Right to data portability

In certain circumstances as defined under applicable law, you have the right to receive the personal data concerning you, which you have provided to us, in a structured, commonly used, and machine-readable format and you may have the right to transmit that data to another controller or to have such personal data transmitted directly from us to another controller, where technically feasible.

Right to object

In certain circumstances as defined under applicable law, you have the right to object, on grounds relating to your specific situation, at any time to the processing of your personal data by us and we can be required to no longer process your personal data unless we demonstrate compelling legitimate grounds for the processing which override your interests, rights, and freedoms or for the establishment, exercise or defense of legal claims.  This notably applies in case of processing of your personal data based on our legitimate interests or for statistical purposes.

Right to object to direct marketing

Where your personal data are processed for direct marketing purposes, you have the right to object at any time to processing for such direct marketing (including profiling related to such direct marketing).

Right not to be subject to a decision based solely on automated processing

Subject to certain restrictions, you have the right not to be subject to a decision based solely on automated processed, including profiling, which produces legal effects on you similarly significantly affects you.

Right to withdraw consent

If you have declared your consent for any personal data processing activities as described in this Privacy Policy, you can withdraw this consent at any time with future effect. Such a withdrawal will not affect the lawfulness of the processing prior to withdrawal of the consent.

We want to make sure that your personal information is accurate and up to date. You may ask us to correct or to remove information you think is inaccurate.

 

How do we process the transfer of your personal data?

Your information may be transferred or transmitted to or stored and processed to third parties and/or other countries outside of where you live for the purposes as described in this Policy. We rely on the European Commission's adequacy decisions about certain countries, as applicable, and obtain your consent for these data transfers to the United States and other countries.

How we share your personal data

We only disclose your personal data to third parties in order to:

  • handle payments securely (Shopify; Reach);
  • fulfil your orders (FedEx, DHL, and third-party companies in our supply chain and ecosystem);
  • provide Customer Care (Gorgias, Mobile Adder, EmailClub);
  • send you newsletters or other updates, that you have up to receive (Klaviyo);
  • send you information relating to your purchases;
  • pay commissions to affiliates where you came to our site from a link they shared with you;
  • target advertising (for example, Google, Facebook signed and Klaviyo);
  • protect you and us to the best of our abilities against fraud and information system and data management related fraudulent events.

Note: The companies named hereabove are currently part of our eco-system. They could change from time to time without any notice to you. Naming these companies does not imply any legally binding relationships between Native Union and them, beyond the potential business agreements Native Union may have contracted with them.

When it is legally required to disclose personal data, such as to regulators, law enforcement bodies, government agencies, courts or other third parties where it is necessary to comply with applicable laws and regulations, or to exercise our legal rights.

Your personal data is never disclosed to third parties for remarketing or retargeting purposes by third parties. Moreover, Native Union never sells its email and contact lists or customer information to anyone.

International data transfers

When we collect, process and share data in accordance with this Privacy Policy, it may be transferred to countries other than where you live. Our data hosting providers’ servers are predominantly located in Hong Kong.

When we do transfer data, we will make sure that there are safeguards in place to protect your personal data.
